This Privacy Policy governs the manner in which INEVIFIT LLC collects, uses, maintains, and discloses your Personal Information collected from Users (each, a User) of the inevifit.com (the “Site” or “we”) when you visit or make a purchase from the Site. This Privacy Policy applies to the Site, all products, our Inevifit and Eros Scale apps, and all services offered by INEVIFIT LLC

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”.

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Site or App, register on the Site, place an order, subscribe to the newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our site. Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

Minors

The Site and services are not intended directly for children. We do not intentionally collect or solicit Personal Information from children or knowingly allow such persons to register. 

When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control.  The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site or App. Non-personal identification information may include the browser name, the type of computer, and technical information about Users means of connection to our Site, such as the operating system and the Internet service provider utilized and other similar information.

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

Mobile App

To improve fitness tracking and health management, you have the option of transmitting the data collected by our Services via the interface provided by the respective providers into the Apple Health Kit, Google Fit, or the Fitbit app. This only happens if you explicitly agree to the process via your device settings.

We have no control over nor are we aware of how the health information is used in the Apple Health Kit, Google Fit, or the Fitbit app. You can object to the processing of this data anytime by disabling the feature in your device settings. Before enabling the respective feature, we recommend reading the privacy policy of Apple, Google or Fitbit.

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions
  • Process orders, and to send information and updates pertaining to orders.
  • Send you additional information related to your product and/or service
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CAN-SPAM, we agree to the following:

We use your Personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

How we protect your information

Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Your rights

GDPR

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. The right to request the deletion of your personal information

If no legal exception applies, as a result of exercising your right, we will delete your personal information and direct any of our service providers to do so.

If you are an adult, you can make a verifiable request on behalf of a minor under your parental authority.

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site.
